foreclosureIS YOUR PROPERTY IN FORECLOSURE? WE CAN HELP.According to recent news reports, foreclosures are at an all time high. Foreclosure is the legal process by which your mortgage company seizes and auctions your home, if you default on payments. Depending on your parish, the sheriff will usually serve you with paperwork informing you that your house is in foreclosure, and listing a sale date for the property. The sheriff’s sale of your property will then be advertised twice in a local newspaper and the property will be auctioned on the assigned sale date. If you are not sure whether your home is in foreclosure, you can contact your parish’s sheriff’s department by telephone to inquire about your property, or if you live in East Baton Rouge Parish, Iberville Parish, or Ascension Parish, you can check online. Below is a listing of local sheriff’s offices: If your house is in foreclosure, you should contact our office immediately. We can stop the sheriff’s sale on your property by filing a Chapter 13 Bankruptcy. Subject to limited exceptions, the filing of the bankruptcy petition will institute the automatic stay protections of the Bankruptcy Code and stop the sale of your property. You will then be allowed an opportunity to catch up your mortgage payments through a chapter 13 plan over a period of 36 to 60 months. Please see our Chapter 13 Bankruptcy page for more information. Our office will file your case up to a day before the sheriff’s sale, however, you should not wait that long to make an appointment with us to discuss your options. It is important that you contact us to set up a free initial consultation as soon as you become aware of the pending foreclosure, or as soon as you become aware that you have fallen behind on your mortgage payments. |
